Terms of Service

The Site describes our professional services, which may include website redesigns and revamps, managed hosting and maintenance, integrations (such as e-commerce, booking, and custom APIs), and related consulting ("Professional Services"). Specific scope, fees, timelines, and deliverables for Professional Services are set out in a separate proposal, statement of work, order, or other written agreement between you and us ("Service Agreement")—not by these Terms alone.

We also provide a complimentary, automated website analysis when you submit our contact form ("Site Audit"). The Site Audit uses publicly available and third-party tools (for example, performance and security signals) and produces a report accessible via a unique link we provide to you. The Site Audit is offered for informational purposes to start a conversation about how we might help; it is not a substitute for a full security assessment, legal compliance review, or guaranteed business or SEO outcome.

You represent that you are at least 18 years old and, if you are using the Site on behalf of a company or other entity, that you have authority to bind that entity. You will provide accurate, current information in any form submission or communication with us.

When you submit the contact form or otherwise contact us, you may provide information such as your name, email address, and website URL. You are responsible for the accuracy of that information and for ensuring you have the right to share any URLs or details you submit. We use submissions to respond to inquiries, perform the Site Audit where applicable, and pursue potential Professional Services engagements, as described in our Privacy Policy (when published) and as otherwise permitted by law.

You agree not to use the Site or contact mechanisms to transmit unlawful, harassing, defamatory, fraudulent, or malicious content, or to impersonate others.

Site Audit reports are generated automatically from public signals, snapshots, and third-party APIs. Results may be incomplete, delayed, or inaccurate for reasons outside our control. A report is not a guarantee of search rankings, conversions, security, accessibility, or legal compliance.

Report links are intended for you and your organization. Anyone with the link may be able to view the report; keep your link confidential if you do not want others to see it. We may disable or remove reports or related data in line with our operational, legal, or retention practices.

The Site, its design, text, graphics, logos, and other content (excluding your submissions) are owned by WebsiteRenewed or our licensors and are protected by intellectual property laws. You may not copy, scrape, reverse engineer, or exploit the Site or our materials except as allowed by applicable law or with our prior written consent.

Rights to deliverables from Professional Services (such as custom designs or code) are governed by your Service Agreement, not these Terms.

You agree not to:

• Probe, scan, or test the vulnerability of the Site or our systems without authorization;
• Interfere with or disrupt the Site, APIs, or servers;
• Use automated means to overload or harvest data from the Site in violation of these Terms or applicable law;
• Use the Site in any way that violates applicable laws or third-party rights.

The Site and Site Audit may rely on third-party services (including analytics, hosting, database, and performance or security tools). Those providers have their own terms and privacy practices. We are not responsible for third-party services we do not control.

THE SITE AND SITE AUDIT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SITE OR SITE AUDIT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR SITE AUDIT (OTHER THAN LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW) SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US $100) OR (B) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM—WHICHEVER IS GREATER, SUBJECT TO APPLICABLE LAW. Professional Services may be subject to different liability caps in your Service Agreement.

You will defend, indemnify, and hold harmless WebsiteRenewed and our affiliates from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site, your submissions, or your violation of these Terms or applicable law, to the extent permitted by law.

We may modify the Site or these Terms at any time. We will post the updated Terms on this page and update the "Last updated" date. Material changes may also be communicated through the Site or by email where appropriate. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the United States and the state in which WebsiteRenewed primarily operates, without regard to conflict-of-law rules, except where prohibited by law. If any provision is unenforceable, the remaining provisions remain in effect. These Terms constitute the entire agreement between you and us regarding the Site and Site Audit (excluding Professional Services covered by a Service Agreement).
